DEFINITIONS AND SCOPE OF THE CONTRACT
The general terms and conditions of sale of this contract (hereinafter also referred to as "TCGV") set forth below, concern the offer and sale of clothing and gadgets with the "ICT - Italian Champions Tour" brand (hereinafter also referred to as "Product" or "Products") available in the "Shop" section of the official website www.italianchampionstour.shop and only "ITC").
The offer and sale of Products in the "Shop" section of the Website constitute a distance contract regulated by Title III of Legislative Decree 6 September 2005, no. 206 ("Consumer Code"), coordinated and updated, most recently, with the amendments introduced by Legislative Decree 10 August 2023, no. 104, converted, with amendments, by Law 9 October 2023, no. 136.
The purchase of products in the "Shop" section is permitted to both "consumer" users and users who do not hold this status.
Pursuant to Art. 3, paragraph I, letter a) of the Consumer Code, natural persons who, in relation to the purchase of products through the "Shop" section of the Website, act for purposes unrelated to any business, commercial, professional, or artisanal activity carried out, are considered consumers.
Pursuant to Art. 49 of the Consumer Code, ITC provides the Customer with the following information.
The registered office and contact details of the Website owner, as well as the domain name, are: INTERNATIONAL COMMUNICATION S.r.l., with registered office in Naples at Via Generale Orsini 47, VAT number 09139511217, email internationalcomunicationsrl@gmail.com
For each Product in the "Shop" section of the Website, the following are provided: a description of the Product, some additional information, and user reviews that the Customer can view before purchasing.
On the Product purchase web page of the Website, information is provided regarding: the Product price; any additional costs; shipping costs; payment methods and Product delivery methods; the conditions, terms, and procedures for exercising the right of withdrawal; the cost of returning goods in case of withdrawal - if expressly provided by the seller - if they cannot normally be returned by post; a reminder of the existence of the legal guarantee of conformity for goods; the conditions of after-sales assistance to the consumer, after-sales services, and commercial guarantees.

CONCLUSION OF THE CONTRACT - INFORMATION TO CUSTOMERS
2.1. The contract stipulated between International comunication srl and the Customer is considered concluded when International comunication srl receives, through the Shop section, the order and payment for the purchased Products ("Conclusion of the Contract"), followed by a purchase order confirmation to the email address provided by the Customer.
The receipt of an order by International comunication srl, which is not followed by an immediate payment by the Customer or within the terms indicated in point 3 - for credit card payments, does not constitute the Conclusion of the Contract.
By placing an order in the manner provided by the Website, the Customer declares that the personal data provided is correct and fully accepts the TCGV set forth below.
2.2. The Customer undertakes and is obliged, after completing the Product purchase procedure, to print and store the TCGV and the purchase order confirmation sent by International comunication srl.
2.3. The Customer guarantees that the data provided during the Product purchase procedure is complete, truthful, refers to the Customer themselves and not to third parties, and undertakes to hold International comunication srl harmless from any damage, compensation obligation, and/or patrimonial and non-patrimonial claim from third parties, possibly connected to the untruthfulness of the personal data provided. Should such a hypothesis occur, International Comunication srl is exempt from any responsibility regarding the delivery of the Product(s) and reserves the right to legally pursue any violation and abuse related to the provision of untruthful personal data, in the competent offices and to protect its interests.
2.4. The order will be processed, only after payment, to the address provided by the Customer.

PURCHASE METHODS – ORDER ACCEPTANCE
3.1. The Customer can only purchase Products available in the "Shop" section of the Website, as described in their respective information sheets. It is understood that the image accompanying the descriptive sheet of a Product may not perfectly represent its characteristics but may differ in color, dimensions, and other details present in the figure that do not, however, affect the quality of the Product.
3.2. The "Shop" section of the Website can be visited by multiple Customers simultaneously, and for this reason, it may happen that multiple Customers purchase the same product at the same time. Due to simultaneous purchase, the Product could therefore appear available for a short period, even if it is no longer so.
It could also happen that, due to exceptional and unpredictable events, the Product, at the time of withdrawal for delivery to the courier, is missing or damaged and therefore cannot be shipped, and there are no other identical products that can be delivered.
In such cases, International Comunication srl will immediately inform the Customer, via email to the address provided by the Customer.
The Customer may immediately terminate the contract, canceling the purchase order without any cost, or may avail themselves of one of the following options: (i) still receive the Product with an extension of the delivery terms where possible; (ii) receive a different Product, at the Customer's choice, of equivalent or higher value, subject to payment, in the latter case, of the difference; (iii) obtain a purchase voucher of an amount equal to the purchase made, to be used in the "Shop" section of the website www.italianchampionstour.shop; (iv) request a refund of the price paid.
3.3 By proceeding with the purchase of the Product through the "Shop" section of the Website, by clicking "Buy now", the sales contract between International Comunication srl and the Customer is considered concluded at the time of payment of the order by the Customer to International Comunication srl.
Upon receipt of payment, International Comunication srl undertakes to communicate via email, to the email address provided by the Customer, the confirmation of the purchase order for the Product(s). This purchase order confirmation message will include the date and time of order execution, an 'Order Number' (to be used in all further communications with International comunication srl), the name of the product or products purchased, the total price, shipping information, a detailed description of the products, understood as the terms of sale:
The message reiterates all the data entered by the Customer, who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
The purchase order placed by the Customer can be viewed in their " Customer area " on the Website and will be displayed with the status "completed".
3.4. In case of non-acceptance of the order by International comunication srl, the Customer will be immediately informed via email to the address provided.
3.5. For Products in the "Shop" section of the Website bearing the words "Product not available" or "Product arriving soon", International comunication srl allows the Customer to order such Products, committing to forwarding the order to its supplier. In this case, International Comunication srl, after informing the Customer of the estimated time of Product availability, as communicated by the distributor, asks the Customer, within 24 hours of the communication, to confirm acceptance of the estimated times. If, on the date foreseen by the supplier for availability, the Products are not available and the Customer has already proceeded to the Conclusion of this contract, they may proceed with one of the methods indicated in hypotheses (i), (ii), (iii), (iv) of point 3.2.
3.6. If the Customer proceeds to the Conclusion of this contract which includes several Products, including those with the wording "not available" or "arriving soon", International Comunication srl informs that the order will be shipped only when all requested Products are available. Therefore, no partial shipments will be made.

ACCEPTED PAYMENT METHODS
4.1. International Comunication srl allows payment of the order by: Credit Card (the purchase in this case is considered confirmed when International Comunication srl receives the payment).

DELIVERY METHODS AND TIMES
5.1. The delivery of the Products referred to in this distance Contract concluded pursuant to these TCGV will be carried out within the term provided by Article 61 of the Consumer Code. The terms for the delivery of purchased Products start from the day following that on which International Comunication srl received payment.
If it does not fulfill the obligation to deliver the Products within the agreed term, the Customer has the right to request delivery within an appropriate additional term given the circumstances. If this additional term is also not met by International comunication srl, the Customer is entitled to terminate the distance Contract.
International Comunication srl reserves the right to also accept orders with delivery to other European countries. In this case, International Comunication srl will only accept payment by credit card or PayPal. Shipping costs for orders from countries other than Italy will be calculated by the system on the Website. For each order placed, International Comunication srl issues a regular fiscal receipt and/or invoice which will be sent to the Customer together with the purchased Product(s).
5.2. Standard delivery with express courier will normally take place at the following times: from 9:00 AM to 6:00 PM, every day, from Monday to Friday.
Times may vary depending on the assigned courier. International Comunication srl suggests providing a valid and reliable address to ensure successful delivery.
International Comunication srl suggests that Customers check for any updates and notices via pop-ups on the Website.
ATTENTION: the delivery times reported above should be considered indicative and may vary due to logistical reasons or those dependent on the assigned courier.
5.4. No liability can be attributed to International comunication srl in case of delay in the delivery of the Products, as well as in case of damage to the Products if such responsibility is directly attributable to the courier or the Customer.
5.5. Unless the Customer indicates otherwise at the time of purchase, delivery is understood to be at street level. Upon delivery of the Products by the courier, the Customer is required to check: that the number of Products corresponds to the number purchased and indicated in the transport document; that the packaging is intact, not damaged, wet or otherwise altered, including the sealing materials (adhesive tape or plastic straps). Any damage to the packaging and/or the product or the discrepancy in the number of Products with those purchased must be immediately reported by the Customer, by affixing the words "CONTESTED" on the courier's delivery receipt and also indicating the reason for this reservation (e.g., Contested - damaged package/altered product; Contested - products not matching the order).
At the same time, within 1 hour of delivery by the courier, the Customer must send proof of the reason for the dispute (e.g., a photo showing the problem found) via email to internationalcomunicationsrl@gmail.com.
Once the courier's document has been signed, the Customer can no longer raise any issues regarding the external characteristics of what has been received. If the evidence sent to International Comunication srl suggests tampering by the Customer - for example, if the warranty seals (protective envelopes) are not present - International Comunication srl reserves the right not to refund the Products.
Otherwise, International Comunication srl will refund the purchase price of the disputed Product or Products or, at the Customer's discretion, resend the purchased and disputed Product or Products.

RIGHT OF WITHDRAWAL
6.1 The Customer has in any case the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within 14 (ten) working days from the date of signing this contract, to be communicated to International comunication srl by certified email (PEC) or registered letter with acknowledgment of receipt.
The withdrawal notice can also be sent, within the same period, by email, provided that it is confirmed by certified email (PEC) or registered letter with return receipt within the following 48 hours.
In case of exercising the right of withdrawal, the communication must be sent to the following address: internationalcomunicationsrl@gmail.com pec internationalcomunicationsrl@pec.it
The withdrawal period expires after 14 days from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the last ordered good. In the case of a contract relating to multiple goods ordered by the Customer in a single order and delivered separately, the 14-day period starts from the day on which the Customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good.
To exercise the right of withdrawal, it is necessary to inform International Comunication srl via pec internationalcomunicationsrl@pec.it of the decision to withdraw from this contract by means of any explicit declaration to that effect.
6.2 For the valid exercise of the right of withdrawal, the Customer is required to return the received Products at their own care and expense, at the latest within 30 (thirty) days from the date of receipt of the goods; they must be returned intact and, in any case, in a normal state of preservation. The right of withdrawal is however excluded for sealed Products that are not suitable for return for hygienic reasons or reasons related to health protection and that have been opened after delivery, such as, by way of example only, cosmetic products for body care and beauty.
International comunication srl will refund the full amount paid by the buyer free of charge within 30 (thirty) days from receipt of the withdrawal communication and will do so through the credit institution that issued the credit card used for payment or by crediting the amount to the bank account indicated by the customer.
International Comunication srl reserves the right to reject any Product returned in a manner other than those specified above, as well as Products for which the return costs have not been fully paid by the Customer where due, or the methods and times indicated for communicating the exercise of the right of withdrawal have not been respected.
6.3. Without prejudice to the Customer's ability to communicate the withdrawal in the form they deem appropriate, as indicated above in point 6.1, the Customer who intends to withdraw from the TCGV using the format shown below, to the following PEC address: internationalcomunicationsrl@pec.it

APPLICABLE LAW
9.1 The TCGV between the Customer and International comunication srl represent the distance selling contract between International comunication srl and the Customer and are understood to be concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of their municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the court of Naples.

CONDITIONS
11.1 The conditions contained in this document may be modified by International Comunication srl without prior notice and will be valid from the date of publication on the Website.
